In October of the same year, Florida Governor [[Wikipedia:Cary A. Hardee|Cary A. Hardee]] appointed Penton as [[Escambia County Sheriff]]. Voters elected Penton was elected Sheriff in his own right sheriff in [[1924]], and was he won re-elected in [[1928]].

Penton married Allie May Burch on [[September 9]], [[1917]]. The couple had two sons, Douglas and Kenneth. The family lived at 1216 East Lee Street in Pensacola's [[East Hill]] neighborhood, underscoring Penton's strong connection to the community he served.
